Kansas law is quite peculiar in letting out-of-state PACs have fewer reporting requirements than in-state PACs. Out-of-state groups are allowed to spend huge amounts on Kansas politics and not have their “verified statements” shown online. There is no online list of out-of-state PACs that get to hide their political participation in Kansas’ elections. As previously reported by the Meadowlark recently, some of these out-of-state PACs should be listed in the “Top 20″ list of Kansas PACs, but this does not happen.
In a preliminary look at the verified statements filed in 2008, over $500,000 of political money is not being reported online to the public for out-of-state PACs. A huge $100,000 transfer was reported on a single sheet of paper, but was never published online. Why?
Table 1 below shows that out-of-state PACs reported contributions of $459,438 on verified statements. Table 2 shows that in-state Kansas PACs reported $62,657 on verified statements instead of normal reporting required of Kansas PACs.
A single-page verified statement showed a single $100,000 contribution by the SEIU PAC to Gov. Sebelius’ Bluestem Fund PAC. See Figure 1 (below). The Bluestem PAC spent that money to support Democrats and oppose Republicans in a number of legislative races, yet the out-of-state SEIU PAC’s $100,000 contribution is not published online for voters to know about?
“Verified statements” can only be reviewed by visiting the Secretary of State’s Office in Topeka, and asking the right questions to the right persons.
Verified statements normally show amounts of money raised in Kansas, or raised for use in Kansas, and the amount spent in Kansas. However, in at least one case, an out-of-state PAC never filed a complete statement of their political money in any state.
Representatives from both the Ethics Commission and the Secretary of State’s Office commented that I’m the only one to ever ask about verified statements. Since I spent quite some time studying political money in Kansas before I knew enough to ask about these reports, isn’t it highly likely few people know these reports exist?

The Form LM-2 filed by SEIU National Headquarters in 2007 with the U.S. Department of Labor showed $32,935,792 spent on political activities and lobbying. A very large $100,000 sent to Kansas would likely be only a small part of the money SEIU spent nationally on politics in 2008, based on the amount of money SEIU had in 2007. The SEIU Headquarters LM-2 is not yet available for 2008.
